Version: November 2026
§ 1 Scope and provider
These General Terms and Conditions (GTC) apply to all contracts between D&T PHOTOgraphy & Visual Arts GbR, represented by Davia and Torsten Wieczorek (hereinafter “D&T” or “we”), and its customers (hereinafter “participant” or “customer”) for the services offered on dtphotography.eu. Our address and contact details can be found in the imprint.
Deviating terms of the customer only apply if we have expressly agreed to them in writing.
§ 2 Services
D&T offers in particular: workshops on historical photographic and alternative printing processes on fixed dates, wet plate portrait sessions (on fixed dates at the studio, at events or by arrangement), webinars and alternative prints made to order.
The content, duration, venue and price of each service are stated on the respective offer page or event description at the time of booking, or in our individual quote.
Workshops held as part of festivals or third-party events and booked via their website (e.g. ROTLICHT Festival) are subject to the terms of the respective organiser.
§ 3 Booking and conclusion of contract
The presentation of dates on our website is not a binding offer but an invitation to book.
By submitting the booking form and clicking the payment button (“book with obligation to pay” or PayPal) you make a binding offer to conclude the contract. The contract is concluded when the booking is confirmed on the website and by email.
For services on request (e.g. alternative prints, preferred dates for portrait sessions) the contract is concluded when you accept our quote by email.
The number of places per date is limited; places are allocated in the order of fully paid bookings. If a date is already fully booked despite payment, we will refund the amount paid promptly and in full.
§ 4 Prices and payment
All prices stated are final prices. In accordance with § 19 of the German VAT Act (UStG, small business regulation), no VAT is charged.
For workshops, materials are included in the price unless stated otherwise in the description. Travel, accommodation and meals are not included.
Online bookings are paid at the time of booking via the payment service PayPal (PayPal account, direct debit or card via PayPal). For services on request, payment is made after the quote by bank transfer or PayPal; alternative prints are usually paid before shipping. Shipping costs for prints are shown separately in the quote.
§ 5 Cancellation by the participant
You can cancel a booked participation at any time by email. The date of receipt of the cancellation by us is decisive. The following cancellation terms apply:
- up to 30 days before the date: free of charge (full refund)
- 29 to 14 days before the date: 50% of the price
- 13 days or less before the date, or non-attendance: 100% of the price
You may name a substitute participant at any time free of charge; please let us know their name before the date.
In the event of non-attendance without cancellation, the full price is payable. You remain entitled to prove that we have suffered no damage or less damage.
You can rebook a wet plate portrait session once free of charge to another available date up to 7 days before the date.
§ 6 Cancellation and changes by D&T
We reserve the right to cancel a date for good cause, in particular if the instructor is ill, there are too few participants, due to official requirements or force majeure. In this case we will inform you as early as possible and refund any amounts already paid in full or – at your choice – offer an alternative date.
Further claims, in particular for reimbursement of travel and accommodation costs, are excluded unless we caused the cancellation intentionally or through gross negligence.
Minor changes to the schedule, times or venue within the same city remain reserved, insofar as they are reasonable for you.
§ 7 Conduct, safety and participation
Chemicals are used in the historical processes. Participants must follow the safety instructions of the instructor and use the protective equipment provided. Please inform us in advance of allergies, pregnancy or health restrictions.
Participation in workshops is possible from the age of 18; young people aged 14 and over only when accompanied by a parent or guardian and after prior arrangement.
Anyone who endangers the safety of others despite being warned may be excluded from further participation; in this case there is no entitlement to a refund.
§ 8 Wet plate portraits and image rights
Wet plate collodion portraits are handmade originals. Irregularities, streaks, edges and tonal variations are typical of the process and do not constitute a defect.
The copyright in the images created remains with D&T. You receive the physical plate or the agreed image for private use. D&T will only publish your portrait (e.g. on the website or social media) with your express consent.
You may freely use images and prints you create yourself in a workshop for private, non-commercial purposes.
§ 9 Alternative prints
Alternative prints are made individually according to your specifications. Handmade prints naturally differ from one another and from the on-screen display in colour, contrast and texture; this does not constitute a defect.
If you provide your own image files, you warrant that you hold the necessary rights and that no third-party rights are infringed.
Delivery times are non-binding unless a delivery date has been expressly agreed. The statutory warranty rights apply.
§ 10 Information on the right of withdrawal
For bookings of workshops, portrait sessions and events on a fixed date there is no right of withdrawal pursuant to § 312g (2) no. 9 of the German Civil Code (BGB), as these are services related to leisure activities for which a specific date is provided. The cancellation terms in § 5 apply.
For alternative prints made to your individual specifications there is likewise no right of withdrawal pursuant to § 312g (2) no. 1 BGB.
Where a statutory right of withdrawal exists for a service (e.g. a webinar without a fixed date), we will inform you separately at the time of booking.
§ 11 Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health.
In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.
We accept no liability for items brought along (e.g. cameras, clothing) unless there is intent or gross negligence. We recommend wearing work clothes that may come into contact with chemicals.
§ 12 Data protection
Information on the processing of your personal data can be found in our privacy policy.
§ 13 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 14 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory consumer protection provisions of the state in which they have their habitual residence.
Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
